Terms of Use for Rhythm

Welcome to Rhythm! These Terms of Use ("Terms") govern your use of the Rhythm service (the "App," "Service," or "Platform"), which is owned and operated by Rhythm Labs Inc. ("we," "us," or "our").

By using Rhythm, you agree to these Terms. If you do not agree, please do not use the app.

1. What Rhythm Is — and Isn't

Rhythm is a wellness support tool powered by AI. It's designed to offer grounding, thoughtful responses to emotional and everyday challenges. But it's important to understand what Rhythm does not do:

  • Rhythm is not a medical service
  • Rhythm is not a therapist or counselor
  • Rhythm is not for crisis support

We do our best to offer gentle, supportive responses, but you are responsible for your own decisions and wellbeing. If you are in crisis or facing a medical emergency, contact a professional or emergency services.

Rhythm uses advanced language models (like OpenAI and Anthropic) to generate its responses. Sometimes they might get things wrong, sound odd, or reflect unexpected biases — that's just the nature of this kind of technology.

By using Rhythm, you understand and accept this. We'll always try to build thoughtful safety guidelines into the system, but:

  • Responses may not be 100% accurate or helpful
  • You shouldn't rely on Rhythm for anything serious like medical, legal, or crisis help
  • Please use your own judgment — and ask a real human when it counts.

2. Eligibility

To use Rhythm, you must be:

  • At least 18 years old if you're in the United States or Canada
  • Able to enter into a legal agreement in your jurisdiction

We do not knowingly allow children under these age limits to use the service. If you are a parent or guardian and believe your child is using Rhythm without your consent, please contact us at [email protected].

3. Your Account

You are responsible for:

  • Keeping your login credentials secure
  • All activity under your account
  • Providing accurate registration information

If you suspect unauthorized use of your account, notify us immediately.

4. Privacy and Data Use

Your use of Rhythm is subject to our [Privacy Policy]. We take your privacy seriously:

  • We encrypt your messages in the database using AES-GCM
  • We do not sell or share your data with advertisers
  • Data may be shared with trusted partners (like OpenAI) only to generate responses, not for training their models
  • We may automatically analyze your chat messages to classify content (e.g., topics like “work,” “relationships,” or “self-improvement”). This process is fully automated, anonymized, and de-identified — no humans see your messages. Only aggregated insights are used to improve Rhythm and its features.
  • We may also collect limited anonymized metadata about your usage (like message count, button clicks, feature usage, session activity, or general app performance) to understand and improve the experience.
  • You agree that we may use anonymized and aggregated data to improve our services and, in the future, potentially to train our own systems.

5. Acceptable Use

You agree not to:

  • Use Rhythm in any way that violates laws or regulations
  • Use it to harm, threaten, or harass others
  • Attempt to reverse-engineer, exploit, or misuse our systems
  • Upload or input false, misleading, or malicious content

We reserve the right to suspend or terminate accounts that violate these guidelines.

6. Intellectual Property

All content, branding, and software that powers Rhythm is the intellectual property of Rhythm Labs Inc or licensed to us.

  • You may not reproduce, modify, distribute, sublicense, resell, or create derivative works of our app without permission
  • You retain ownership of your own messages, but by using the app you grant us a license to use them for the purpose of providing the service

7. Updates and Modifications

Rhythm is constantly evolving. This means we may:

  • Change or remove features
  • Add new limitations, pricing, or access tiers
  • Update these Terms

We may also install software updates automatically. By continuing to use the app, you agree to receive and accept those updates.

We'll notify you if we make material changes. Continued use means you accept the updated Terms.

8. Pricing & Subscriptions

Rhythm offers both free and paid subscription plans. When you subscribe to a paid tier, you agree to the following terms:

a. Billing & Payment

Paid plans are billed through the App Store, Google Play, or our web payment provider (such as Stripe).

By starting a subscription, you authorize Rhythm Labs Inc. to charge the applicable fees to your chosen payment method.

All fees are in the currency shown at checkout and are non-refundable except where required by law.

b. Auto-Renewal

All subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date.

You can manage or cancel your subscription at any time through your device's app store settings or your Rhythm account, depending on where you originally subscribed.

Canceling stops future charges, but does not retroactively refund past charges.

c. Changes to Plans, Pricing, or Features

We may update our pricing, introduce new plans, modify features, or discontinue certain tiers.

When we make material changes (like pricing adjustments or significant feature updates), we will give you reasonable advance notice via email or in-app notification.

Changes take effect at the start of your next billing cycle unless we state otherwise.

By continuing to use Rhythm after the changes take effect, you agree to the updated pricing or plan structure.

If you don’t agree with the changes, you may cancel your subscription before the renewal date.

d. Trials, Intro Offers, and Promotions

We may offer free trials, discounted introductory periods, or promotional plans.

If you sign up for a trial, we’ll clearly explain when the trial ends and when billing begins.

You can cancel before the trial ends to avoid charges.

Promotions cannot be reused unless the terms explicitly allow it.

e. Upgrading or Downgrading Plans

If you upgrade your plan, the change may take effect immediately, and you may be charged a prorated amount.

If you downgrade, the change typically takes effect at the start of your next billing cycle.

Some features may not be available after a downgrade.

f. Taxes

Subscription fees may be subject to applicable taxes depending on your location.

You are responsible for paying any such taxes, which will be included at checkout where required.

g. Failed Payments

If a payment fails, we may attempt the charge again.

We may also suspend access to paid features until payment is successfully processed.

Your account will remain active on the free tier unless otherwise suspended under our Terms.

9. Third-Party Tools and Components

Rhythm may include tools or services from third parties (like OpenAI, hosting providers, or libraries).

Some of these may be governed by separate license terms, and by using Rhythm, you agree to comply with those where applicable.

10. Disclaimers

Rhythm is provided "as is." We make no guarantees about:

  • Accuracy of responses
  • Fitness for any particular purpose
  • Availability of the service at all times

Rhythm Labs Inc. is not responsible for any decisions you make based on Rhythm’s responses. Rhythm is provided for informational and wellness support purposes only. Always consult qualified professionals for medical, legal, or other serious personal concerns.

11. Limiting Liability

Rhythm is designed to support you gently — but we cannot guarantee perfect accuracy, reliability, or availability at all times. By using the app, you agree that:

  • Rhythm Labs Inc. is not responsible for any decisions you make based on Rhythm’s responses.
  • Rhythm Labs Inc. is not liable for lost data, emotional distress, missed opportunities, or other outcomes resulting from use of the app.
  • Rhythm Labs Inc. cannot be held responsible for any harm resulting from third-party services, content, or integrations.

Basically: Rhythm is here to provide support and guidance, but you remain fully responsible for your choices.

If a claim is brought against Rhythm Labs Inc. because of your use of the app, you agree to assist in covering reasonable costs, including legal fees. This helps us maintain a safe, supportive space for all users.

12. Export and Legal Compliance

You agree not to use Rhythm in any way that violates Canadian or international export laws.

This includes downloading or using Rhythm in countries or with individuals that are subject to trade restrictions under Canadian law.

13. Termination

You may stop using Rhythm at any time.

You can manage or cancel your subscription at any time through your device's app store settings or your Rhythm account, depending on where you originally subscribed.

Canceling stops future charges, but does not retroactively refund past charges.

We may suspend or terminate your access if you:

  • Violate these Terms
  • Use the service in harmful or illegal ways
  • Pose a risk to the platform or other users

14. Governing Law

These Terms are governed by the laws of British Columbia, Canada, and the applicable laws of Canada.

15. Solving Disagreements

If a serious disagreement arises between you and Rhythm Labs Inc., we will first attempt to resolve it privately and in good faith.

If a resolution cannot be reached, the matter will be resolved through binding arbitration in British Columbia, Canada, in accordance with applicable arbitration laws.
